Maternity leave is one of the few HR topics where getting the process wrong is both a compliance failure and a retention failure. The Bangladesh Labour Act 2006 sets a clear baseline; the gap is usually in how HR administers notice, payment timing and records.

Key takeaways

  • Eligible employees receive 16 weeks of maternity leave — 8 weeks before and 8 weeks after delivery.
  • Eligibility normally requires at least six months of service with the employer.
  • The benefit is generally limited to employees with fewer than two surviving children; others still take leave, but paid status follows your policy.
  • Maternity benefit pay is based on average daily wages over the preceding period.
  • An employer must not dismiss a woman during her maternity leave or engage her in work during the protected period.

Calculating maternity benefit

The benefit is paid at the employee''s average daily wage, computed over the wages actually earned in the period preceding the notice, divided by the days worked.

Average daily wage = Total wages in the reference period ÷ Days worked
Maternity benefit = Average daily wage × Days of leave

Worked example

An employee earns ৳36,000 gross per month. Her average daily wage works out to roughly ৳1,200. For a 112-day (16-week) leave period, the benefit is approximately ৳1,34,400, paid in the instalments your policy sets — commonly half at commencement of leave and the balance after delivery on production of the birth certificate.

Pay the second instalment promptly. Late maternity payment is the single most common complaint raised in this area.

What HR must actually do

  1. Log the notice — date received, expected delivery date, service length verified.
  2. Confirm eligibility in writing, stating leave dates and the payment schedule.
  3. Freeze the payroll rules — no absent deduction, no attendance penalty, and continued provident fund treatment per your fund rules.
  4. Protect the role — no dismissal or termination notice during the protected period.
  5. Record the return date and plan a light re-onboarding, including any nursing break arrangement your policy grants.
  6. Retain records for inspection.

Common mistakes

  • Treating the leave as unpaid because attendance shows absence — configure a distinct paid leave type instead.
  • Counting maternity leave against annual or sick leave quotas.
  • Paying the whole benefit late, after delivery.
  • Missing the eligibility check on service length and applying the wrong policy tier.
  • No written policy at all, which leaves each case to be argued individually.

Make it a configured leave type, not a manual exception

The reliable fix is to define maternity leave as its own leave type with its own conditions — minimum months of service, employment type eligibility, and paid status — so the payroll engine, the attendance register and the leave balance all agree without HR intervention. Our guide on leave management best practices covers the wider policy design, and the Bangladesh Labour Act compliance checklist shows where maternity records sit in an inspection.

In AIHR BD you set the eligibility rules once — service length, employment types, paid or unpaid — and employees only see the leave types they actually qualify for when they apply.
